Climate change is a true planetary crisis with serious consequences for biodiversity and human rights. Managing this emergency is a challenge for governments, businesses, and civil society as a whole, and the transition from fossil fuels to renewable energy sources plays a key role.
This report analyses the current state of the just energy transition in four countries of the Latin American region: Brazil, Chile, Colombia and Mexico, focusing on regulatory and public policy advances, which determine the country-specific implementation of various laws. To address the different aspects and challenges posed by the just energy transition, this research reviews six relevant topics and determines how these are regulated in each country. Furthermore, it reviews the extent to which those frameworks and public policies in Latin America comply with human rights standards and promote a just transition, as well as identifying patterns, trends, and gaps. Finally, it presents general recommendations to adapt the internal legislation and public policies to the international human right standards as wells as country-specific recommendations for each jurisdiction.

Marco jurídico sobre la transición energética en Brasil, Chile, Colombia y México: evaluación de la situación actual y recomendaciones para un futuro más justo
En la actualidad, el cambio climático constituye una verdadera crisis planetaria, con graves consecuencias en la biodiversidad y en los derechos humanos, por lo que su gestión constituye un desafío a nivel global tanto para los gobiernos, como para las empresas y miembros de la sociedad civil, y la transición en el sector energético desde la utilización de combustibles fósiles y su reemplazo por fuentes de energías renovables cumple un rol crucial.
El presente informe analiza el estado actual de la transición energética justa en cuatro países de la región: Brasil, Chile, Colombia y México, analizando los avances regulatorios y de política pública, con el objeto de conocer su estado e implementación en las normativas de cada país.
A fin de abordar debidamente las distintas aristas y desafíos que plantea la transición energética justa, se han revisado seis materias de interés junto con su regulación en los marcos normativos de los distintos Estados. Asimismo, identifica en qué medida los marcos normativos y las políticas públicas sobre transición energética en América Latina cumplen con los estándares internacionales de derechos humanos y promueven una transición justa, identificando patrones, tendencias y brechas. El documento presenta una serie de recomendaciones generales para adecuar la normativa y políticas internas a los estándares internacionales de derechos humanos así como recomendaciones específicas para cada jurisdicción.
