Migrant, refugee and asylum-seeking women and girls in Europe face persistent inequalities and barriers to protection and enjoyment of their fundamental rights. The COVID-19 pandemic has amplified this discrimination, and created new outcomes that disproportionately impact migrant women and girls. This report is a publication by the European Network of Migrant Women (ENOMW) with design support from the Thomson Reuters Foundation. TrustLaw facilitated pro bono legal research support from Hogan Lovells LLP, Latham & Watkins LLP, Uràa Menéndez – Proenà§a de Carvalho, Linklaters LLP and Selma Korichi (independent lawyer) to inform this report.

Digital assets are becoming increasingly important. Data is the fuel used by large companies to create consumer categories. In Argentina, the Data Protection Law was enacted in 2000 and, with the surge in popularity of social media and a world that is changing, this law is no longer a protective mechanism.
TrustLaw, the Thomson Reuters Foundation’s global pro bono service, connected Democracia en Red with law firms in Argentina, France, Chile, Colombia, Canada, Brazil, Spain, Mexico and Uruguay to produce legal research on legislation on data protection applicable to the public and private sectors locally.
This report addresses five aspects related to current legislation: main laws and regulations, gender perspective, enforcement authority, government access to personal data and implicit consent. We thank the valuable contributions made by Bruchou Fernandez Madero & Lombardi; KLA Advogados; Gomez-Pinzón Abogados; Dentons Canada LLP; ObradorDigital Legal; Hogan Lovells International LLP; DLA Piper Paris; Goebel & Muthspiel; and Cervieri Monsuarez.

………………………………………………………………………………………………….

October 2020: In collaboration with the Associação Brasileira de Captadores de Recursos and Koury Lopes Advogados (KLA), TrustLaw has published this guide on the new Brazilian “General Data Protection Law and Fundraising – Questions and Answers”, which analyzes the main changes to the law and answers several questions related to how the new law impacts fundraising.

Digital rights are a new frontier of human rights. The Thomson Reuters Foundation (TRF) raises awareness of the impact of technology on people and society. Through its global pro bono legal service, TrustLaw, TRF provides vital tools and resources to environmental, humanitarian and social organizations, including guidance on navigating the often uncharted and challenging territory of data regulation and legislation.
In August 2018, Brazil passed a General Data Protection Regulation, lei Nº 13.709, which became effective in September 2020. This new law impacts the work of civil society organizations in Brazil, who are in need of guidance as to how the law affects them, their fundraising strategies and their communications with donors.

We hope this publication becomes a valuable tool to support civil society organizations in Brazil to navigate the new data protection law and to empower them to act with confidence when dealing with personal data so that they can ultimately achieve their fundraising goals and become financially sustainable.

For so many generations indigenous communities have been unaware of the legal mechanisms they can use to demand the recognition and protection of their rights, especially their biocultural property, which refers to the knowledge and practices of indigenous people and their biological resources, from the genetic varieties of crops and medicine they develop to the crafts they design.

Through TrustLaw, the Thomson Reuters Foundation’s global pro bono service, Fundación Nativo analyzed the legal protections available in Australia, Brazil, Bolivia, Canada, Mexico, Peru, South Africa, the United States and Venezuela, thanks to the contributions made by Mattos Filho, Veiga Filho, Marrey Jr. e Quiroga Advogados; LegalVision; DPLAW – Pontes, Pinto & Pignaneli Advogados Associados; Ferre Abogados; McCarthy Tétrault LLP¸ Baker & McKenzie LLP; Hogan Lovells; Herbert Smith Freehills and Lega Abogados.

This report contains a comparative overview of the legislation on the protection of biocultural property in these countries and seeks to raise awareness as well as inform indigenous leaders about the ways in which they can protect the biocultural property of their communities and provide information and inspiration to organize themselves and advocate for new legislation that specifically protects these rights.
